TERMS OF USE
These terms form a binding agreement between you and Earned Game Online ("Earned", "we", "us") governing your use of the Earned game and website. By creating an account or continuing to use the service you agree to them, together with our City Rules, Acceptable Use Policy, Privacy Notice and — if you buy anything — our Terms of Supply.
1. Your account
You must be old enough to form a binding contract in your country, or have the consent of a parent or guardian who accepts these terms on your behalf. You must provide accurate registration information, keep your login credentials secure, and remain responsible for everything that happens on your account. One person may hold one account; accounts may not be sold, shared, rented or transferred.
You may close your account at any time through Support. Closure does not entitle you to a refund except as set out in the Refund Policy.
2. Licence to play
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and play Earned for personal, non-commercial entertainment, subject to these terms. All rights not expressly granted are reserved.
3. The game and virtual property
Earned is an evolving, persistent, multiplayer crime simulation containing fictional violence, criminal themes, simulated gambling mechanics and adversarial player interaction. All characters, events and organisations are fictional.
Cash, credits, items, ventures, crews, reputation and other in-game assets are licensed features of the service. They are not your property, have no monetary value outside the game, and cannot be redeemed for cash. We may rebalance, correct, remove, restore or reset game data where needed to protect fairness, fix defects or reverse the effects of rule-breaking.
4. Rules of conduct
You must follow the City Rules and Acceptable Use Policy, which are incorporated into these terms. In summary: no multi-accounting, cheating, automation, exploiting, market or court manipulation, real-money trading, harassment, hate speech, doxxing, impersonation, illegal content, spam or interference with the service.
5. Content you post
You keep ownership of content you submit — handles, bios, forum posts, mail and crew material. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, adapt and distribute that content for the purpose of operating, moderating and promoting the service. You confirm you have the rights to everything you post. We may remove content that breaches our policies or the law.
If you send us ideas or suggestions, we may use them without obligation or payment.
6. Intellectual property
Earned — including its software, source code, artwork, text, audio, interface design, game systems, databases, and the Earned name, logo and branding — is owned by Earned Game Online or its licensors and protected by intellectual property laws. You may not copy, resell, redistribute, sublicense, reverse-engineer, decompile, scrape, or create derivative works from the service or its content except to the extent the law expressly permits.
7. Purchases
Our order process is conducted by our online reseller Paddle.com, which is the Merchant of Record for all our orders and handles payment, tax, billing enquiries and returns. Full purchase terms are set out in our Terms of Supply, pricing is shown publicly on the Boosts page, and refunds are covered by our Refund Policy. Payment reversals may result in removal of the related credits, items or benefits.
8. Moderation, suspension and termination
We may hide or remove content, issue warnings, reverse in-game gains, restrict features, suspend or terminate accounts where reasonably necessary for breach of these terms, non-payment, fraud or security risk, player safety, or legal compliance. Where practical and appropriate we will tell you the reason and you may request a review through Support. In-game arrests, courts and jail are gameplay systems and are separate from service moderation.
We may also suspend or discontinue the service, or any part of it, with reasonable notice where possible.
9. Third-party services
The service relies on third parties including our hosting and backend provider and our payment reseller. Links or integrations to third-party services are provided for convenience and are governed by their own terms; we are not responsible for their content or practices.
10. Availability, warranties and liability
We aim to keep Earned available and working, but the service is provided "as is" and "as available". To the fullest extent permitted by law we exclude implied warranties and do not promise uninterrupted, secure or error-free operation, or that game data will never be lost.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of profits, loss of data, or loss of in-game assets or progress; and our total aggregate liability arising out of the service is limited to the greater of the amounts you paid us in the twelve months before the claim or GBP 100. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded — including consumers' statutory rights.
11. Indemnity
If you use the service in breach of these terms or the law, you agree to indemnify us against reasonable losses, claims and costs arising from that use, to the extent permitted by law and excluding ordinary consumer use.
12. Governing law and disputes
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections and the right to bring proceedings in your local courts. Please contact Support first — most disputes are resolved quickly and informally.
13. General and changes
If any provision is found unenforceable, the rest continues in force. Our failure to enforce a term is not a waiver of it. You may not assign your rights under these terms; we may assign ours as part of a reorganisation or business transfer. These terms, with the policies referenced in them, are the entire agreement between us.
We may update these terms as the game and the law change. Material changes will be notified through the site or by email where appropriate, and continued use after the effective date means you accept the revised terms. Questions go to Support.
